These Terms of Service ("Terms") govern your access to and use of SmartAvatar (the "Service"), provided by SmartAvatar ("we" or "us"). SmartAvatar is an AI avatar generation platform offering various themed avatar generation services. By accessing or using the Service, you agree to be bound by these Terms.

1. Description of Service:

SmartAvatar is a professional AI avatar generation platform offering various themed avatar generation services, including Chinese ethnic minority style avatars, global travel style avatars, Christmas theme avatars, and comic style avatars. We use current popular high-quality AI models to provide users with convenient avatar generation experiences through custom interfaces.

2. Payment Policy:

a. Payment Model: SmartAvatar uses a points recharge model, not a subscription model. You can recharge different amounts of points based on your needs.

b. Points Usage: Different avatar generation tools and different resolution settings will consume different amounts of points. Please refer to the actual feature pages for specific point consumption standards.

c. Points Validity: Currently, points do not expire. Your points will remain in your account until you use them.

d. Payment Methods: We accept major credit cards and other standard payment methods. All transactions are secure and encrypted.

3. Refund Policy:

a. Refund Conditions: You may request a refund under the following circumstances: (1) Unused base points remaining in your account; (2) Service failure preventing normal use; (3) Duplicate charges; (4) Other reasonable circumstances.

b. Points Structure: During promotional campaigns, your recharged points consist of "Base Points" and "Bonus Points". On the pricing page, you can clearly see the points breakdown for each recharge plan (e.g., 10 points + 5 bonus points). Base points correspond to your actual payment amount, while bonus points are additional promotional rewards.

c. Refund Calculation: Bonus points are non-refundable. We will review your recent unused recharge records and calculate refunds as follows: If your remaining balance is less than or equal to your total bonus points, no refund is available; If your remaining balance exceeds your total bonus points, the refundable amount is calculated based on (Remaining Points - Total Bonus Points).

d. Refund Process: To request a refund, please contact our support team via email ([email protected]) and provide your account information, order details, and reason for refund. We commit to responding within 3 business days after receiving your request.

e. Refund Processing: Refund processing time may vary depending on the payment method, typically completed within 5-10 business days. If we do not respond within 3 business days, Creem reserves the right to process the refund on our behalf.

4. Ownership of Generated Content:

The ownership of avatars generated using SmartAvatar belongs to you. You may use them for personal purposes, such as social media avatars, personal websites, or blogs. However, please do not use them for commercial purposes or impersonate others.

5. User Data:

We collect and store user data including name, email, and payment information. We handle this data in accordance with our Privacy Policy. Your uploaded photos are used solely for avatar generation and will not be saved or used for other purposes.

6. Non-Personal Data Collection:

We use web cookies to collect non-personal data to enhance your browsing experience and optimize service quality. For more information, please refer to our Privacy Policy.

SmartAvatar is an independent product and service platform, not affiliated with, endorsed by, or sponsored or authorized by Google, Replicate, Tencent ARC, Ideogram AI, or any other AI model providers. We provide feature enhancement services for underlying AI models through custom interfaces.

10. Updates to Terms:

We may update these Terms from time to time. We will notify users of any material changes via email. Continued use of our services indicates your acceptance of the updated Terms.
